- In order to ensure the quality of our services and the best performance of our servers, we maintain some rules and conditions of use. Contracting and using our services implies acceptance of these rules. THE VALOR SITE CRIATION for COMPANY reserves the right to cancel the account of customers who violate these rules without any prior notice, notification or refund of the amounts paid.
- 1. Hosting1.1. Content not permitted on hosted websites We do not offer hosting for websites of erotic, pornographic or nudity content of any nature (images, text, sound, links, video, banners etc). Content hosting whose access depends on the visitor's legal majority is not permitted. Material hosting of any kind is not permitted in support of racism, Nazism, discrimination or any apology to any crime foreseen in national or international laws. You are not allowed to host websites whose purpose is to practice SPAM, capture or sell mailing lists on the Internet. No disclosure of hacker material, cracker, systems invasion, serial numbers, software piracy, software reverse engineering or any similar material is allowed. We do not offer hosting for virtual card websites or such websites. We do not host websites whose main activity is sending emails to your users
- 1.2. Unallowed Programs or Scripts We do not offer hosting for programs or scripts linked to IRC, Chatrooms, Online Support, Newsletter, Email Marketing, or any other that exaggeratedly uses server resources. We do not allow running programs or scripts that require more than 10 seconds to be processed. We do not allow running scripts or pages that generate infinity loop resource consumption, for example, pages or scripts that reload automatically every given number of seconds.
- 1.3. Hosting more than one site per hosting plan We do not offer hosting for users who use any type of artifice (redirection, frame, alias) to host more than one site per hosting plan. Resource sharing between hosting plans or websites is also not permitted. Example: a website www. abc.com is hosted on another provider or on another plan without ASP support, and uses a directory from another site hosted on our servers to run the scripts. The hosting plan features are of unique use of the domain hosted on our server.
- 1.4. Services (scripts, asp, cgi, php etc) that will be used by other websites The purpose of hosting services is not to provide services to other sites other than yours. Example of scripts of this type: TOPSITES, Banner Exchange services etc. This does not mean that you cannot use these services from other websites. What is not allowed is the development of these services in your hosting plan so that you meet other websites.
- 1.5. Download Content We do not offer hosting for websites that have the main purpose of downloading files.
- 1.6. Copyright / Trademarks and Patents We do not offer hosting for websites that disclose without permission text files, images and music that infringe copyright. For example: Songs in MP3 or any format. You will not be offered hosting service for websites that are violating any Brand and Patent law or using third-party trademarks without your proper authorization.
- 1.7. Content damage to third parties You will not accept content that comes or may cause damage or harm third parties.
- 1.8. Database Remote access to MySQL and SQL Server databases can be made only for database administration. For performance and security issues, the use of the basis for query, inclusion, alteration or deletion of records can only be made from your website hosted on the VALUE SITE CRIATION for ENTERPRISES. Sites hosted on VALUE SITE CRIATION for WORKS cannot use databases hosted on other servers, under penalty of cancellation of the hosting.
- 1.9. Monthly Transfer Each hosting plan offers a monthly transfer limit. It is the responsibility of the client to follow through the statistical report the use of this limit. The VALUE SITE CRIATION for COMPANY will automatically charge additional transfer if the hosting has transferred data beyond the contracted limit. Because it is a shared hosting service, aiming to protect the other customers, the VALUE SITE CRIATION for COMPANY reserves the right to suspend stays whose traffic volume has grown abruptly and prevented the proper functioning of the other hosting of the same server.
- 1.10. DNS support and IPA numbers VALUE SITE CRIATION for COMPANY is the only one responsible for domain DNS management, so that hosted domains must utilise the DNS servers of our infrastructure. Hosts that do not follow this configuration lose the guarantee of hosting functioning as well as technical support. It is up to VALUE SITE CREATION for WORKS to organize the IP numbers of each server, and can change them without notice or notification. Because of this, the client must use IP numbers only for test purposes and make their access as well as perform their settings always using host names of their domain in order to preserve their access even in case of server IP change.
- 1.11. Use of hosting plan Hosting plans and other aggregated services are exclusively intended for shared hosting of websites and emails, and their use is prohibited for other purposes. The use of hosting plans for rent or sale of domains is expressly prohibited.
- 2. Responsibility2.1. Responsibility The customer must be aware that he is solely responsible for all information disclosed on his website taking into account his validity, legality and integrity.
- 2.2. Internet Knowledge The customer agrees to gain basic knowledge about the Internet, its principles and procedures. It is the responsibility of the customer to develop and maintain your site and all its components such as: images, html pages, cgi programs etc. Technical support will not cover doubts related to the technical knowledge necessary to develop and maintain a website.
- 2.3. Security The customer is responsible for the safety and use of your website. The client's password for access to your settings will be treated privately and confidentially and should not be divided with third parties. The customer should keep all the necessary care with respect to their password, making sure to change it periodically, in order to restrict the access of people who are no longer authorized (Example: former employees, former service providers etc).
- 2.4. Dispute for hosting control If the control of the hosting or access passwords runs dispute between two or more persons, the VALUE SITE CRIATION for ENTERPRISES reserves the right to block access to the passwords and send them only to the domain holder, following the data provided on the site where the domain was registered (e.g. contact entity in the Registry.br).
- 2.5. Resale or Services Offers You may not resell or offer your site space to third parties. You will not be permitted to sell or offer cgi services for use of other websites or third parties. The customer will not be able to resell or offer the general public free of charge any service that is part of their plan that does not have a limitation of use without authorization from the VALUE SITE CRIATION to COMPANY.
- 2.6. Improper use of the server Software or procedures within the server are not allowed to impair its functioning. In order that a problem caused by a domain does not affect other domains hosted on the same server, the VALUE SITE CRIATION for COMPANY reserves the right to suspend hosting accounts that are undermining server access or performance until the problem is solved by the client.
- 2.7. Backup The customer is solely responsible for the content of your website, as well as all the files, databases and emails of your hosting. It is your only responsibility to keep up-to-date copy of all data for replacement in case of data loss is why it generated the loss. Although we have backup, the VALUE SITE CRIATION for COMPANY does not guarantee that this backup will be available, nor that it contains up-to-date customer data. In cases where the backup is not available or outdated, the customer will be prompted to send their backup copy for data replacement.
- 2.8. Virus The client must be responsible for the safety of your personal computer using an antivirus capable of detecting the receipt or sending of viruses.
- 2.9. Use policy The customer is responsible for informing third parties of all rules and conditions for the use of the hosting service.
- 3. Email use3.1. Sending emails in large quantities (mass email shipping) The practice of sending mass email, advertising, newsletters, newsletters, news, currents, or any other type of message in quantity is not permitted, regardless of whether the recipient has authorized or requested sending the email and regardless of the server used to be our or third party.
- 3.2. SPAM The use of our servers for sending SPAM is not permitted, subject to immediate cancellation of the accommodation, without prior notice. - 3.4. Penalties Customers who insist on the above practices will have their hosting plans immediately cancelled. You will also have your hosting plans immediately cancelled the customers who:
3.4.1. Sending messages from another SMTP server, however, informing how an address email hosted on our servers, causing all error messages to be received on our servers, causing high processing and related problems, or;
3.4.2. Message cleaning and removal of abandoned email accounts The following criteria will be used to remove messages or email accounts from the server:
3.5.1. Email accounts without activity (no access by POP, IMAP or Webmail) for more than 3 months will be disabled by the system and will no longer receive messages;
3.5.2. Abandoned email accounts (no access by POP, IMAP or Webmail) for more than 6 months will be deleted automatically;
3.5.3. Messages kept in folders Recycle Bin and Spam for more than 30 days will be deleted automatically. The following folder names are considered as "Lixer": Recycle Bin, Deleted Items, Deleted Items, Removed Items, Trash, Trashed Items and Deleted Items. The following folder names are considered as "Spam": Spam, Spams, Junk, Junk Mail, Unwanted Messages and Electronic Trash. Similar names, which also represent folders for storing Trash or Spam may also have their contents deleted automatically.

This type of practice is characterized as relay opening, and can lead to blocking the email or domain account used for this purpose.
- 4. Payment of services4.1. Fees charged by the registration board. The client's responsibility is to pay and control the dues of the fees for the registration and maintenance of his domain with the registrars.
- 4.2. Payment of accommodation The collection by the hosting service is done in a postpaid manner. The customer must pay for the hosting services of the VALUE SITE CRIATION for ENTERPRISES within their due date. The delay in payment will represent the collection of fine and interest. The delay for more than 10 days may represent the blocking of all contracted services. The delay for more than 30 days represents the cancellation of all contracted services (all data will be deleted and your account will be deleted).
- 4.3. Registered data It is the responsibility of the customer to keep your registered data up-to-date so that we can keep in touch when necessary and we can issue by mail the collection for the services provided. Problems generated by outdated or incorrect data are the responsibility of the client. It is also the responsibility of the client to keep up-to-date your domain data with the competent bodies (e.g. Registration.br, InterNIC). VALUE SITE CRIATION for COMPANY will cancel the hosting accounts whose registration data are in disagreement, incomplete or false. E-commerce sites must necessarily display in a visible location on the site pages, commercial name, CNPJ or CPF, address, telephones and other service channels, according to Brazilian legislation.
- Five. Protection of Personal Data – LGPD (Law 13,709/2018)5.1. Purpose of Data Treatment The VALUE SITE CRIATION for COMPANY collects and uses personal data from its customers exclusively for the provision of hosting services for websites and emails, fulfilling for the specific and legitimate purpose of enabling the contracted service.
- 5.2. Legal Bases for Data Treatment The data is processed on the basis of the consent of the holders, execution of the contract, compliance with legal obligations and legitimate interests, always in accordance with the LGPD.
- 5.3. We guarantee the data subjects the right to access, correct, update and request the deletion of their personal data. To exercise these rights, the holder can contact through the service channels.
- 5.4. Data Sharing Personal data may be shared only with partners and service providers required for the execution of contracted services, with a commitment of confidentiality and security.
- 5.5. Security measures We adopt appropriate technical and administrative measures to protect personal data against unauthorized access, loss, destruction or alteration.
- 5.6. Data Retention and Exclusion Personal data will only be kept for the time needed to comply with the informed purposes, and subsequently deleted or anonymized according to applicable law.
- 6. Cancellation Services6.1. It is the customer's obligation to communicate the VALUE SITE CRIATION to WANTS when you wish to cancel the hosting service. This can be done simply and at any time maintaining formal contact with our team. For the following month, it will be charged proportional to the days used until the cancellation request.
- 6.2. It is the client's obligation to backup all of your files before requesting cancellation of the hosting. After cancellation of a hosting account, all files are deleted without possibility of recovery.
